Back in June of 2012, I had the opportunity to attend and feature the Grand Opening of the 4th Smart & Final Store in Bakersfield, but the FIRST Smart & Final Extra! Store!!!  It is a gorgeous store – very clean, well stocked, and comfortable to go shopping in.  I had a great time mingling with staff and touring the store that was to open to the Bakersfield Community the following day.

I am excited to be featuring the Smart & Final Bakersfield Extra Store again and hosting our first Tweet Up Event!  We will be giving away several $25 Smart & Final Cash Cards, so you definitely don’t want to miss out on this opportunity.

TWEET UP TERMS AND CONDITIONS

No purchase is required to enter or win. The SMART & FINAL “Tweet Up” Giveaway (the “Contest“) is being conducted by Collective Bias, LLC. (“CB“).

1           ENTRANTS ARE BOUND BY THESE TERMS AND CONDITIONS: You, a natural person and the subscriber of the Twitter account that has provided an entry into the contest agree to, and accept to be bound by, the CB “Tweet Up” Contest terms and conditions (the “Terms and Conditions“). If you are named the winner, delivery of the prize is contingent upon fulfilling all requirements set forth in these Terms and Conditions.

2           ELIGIBILITY: The Contest is open to all residents of the United States, 18 years or older, excluding employees of Collective Bias, LLC and Smart & Final, their affiliated companies or subsidiaries, their advertising and promotion agencies and members of their respective immediate households and any person domiciled with any of the above. Groups, clubs, organizations, businesses and commercial and non-commercial entities are not eligible. Anyone in CB’s sole discretion that is found to be using multiple Twitter accounts to participate or who is participating in an attempt to hijack the contest will be ineligible.

3           PARTICIPATION: The starting date and time of the contest and the brand that will be featured during the Contest will be announced on http://readheadmomstaging.mystagingwebsite.com/2013/01/you-are-invited-to-the-bakersfield-smart-final-tweet-up-event-win-gift-cards/.  Entrants will go in-store to store #362 located at 4980 Stockdale Avenue, Bakersfield, CA on the date and time posted.  Entrants must check in on Foursquare and Tweet/Facebook a picture of a Corporate Brand item (e.g., First Street, Ambiance or La Romanella item) to the handle @SmartFinal using the hastag #SFbakersfield. The Entrant must comply with the Twitter Rules for tweeting. Winner selection is based upon a first-come/first-served basis.  Once an Entrant complies with the participation rules, they should search for the Host, Shannon Gosney, at the front of the store.  She will be sitting at a table, and will be handing out the prizes to the first 50 eligible Entrants that have complied with the Terms and Conditions set forth herein. 

4           CONTEST LIMITS: You may use only one (1) Twitter account to participate. Posting duplicate, or near duplicate, tweets is a violation of Twitter’s rules and will disqualify the entrant from the Contest.

5           NOTIFICATION OF WINNER: Entrants shall meet with the Host at the front of the store to determine if they are a winner.  If an Entrant, who otherwise would be qualified and determined to be an eligible winner, fails to contact the Host at the store to determine if he/she is a potential winner, that Entrant’s right to a prize will be void and an alternate winner shall be eligible.  

6           PRIVACY: Personal information gathered by CB will be used for the purposes of administering the Contest, contacting potential winners and as otherwise permitted or required by law. Please see CB’s Privacy Policy for information on its policy toward maintaining the privacy and security of your information at www.collectivebias.com .

7           PRIZE PACKAGE: There will be a maximum of fifty (50) Smart & Final gift cards awarded.  Each gift card is worth $25 at Smart & Final.  Limit of one (1) gift card per family.  The odds of winning will depend on the number of eligible entrants.  After all 50 gift cards are distributed to eligible winners, the Contest will be done.

8           TAXES: All taxes for prizes, if applicable, are the sole responsibility of each individual winner. 

9           NO CASH VALUE, NO SUBSTITUTES AND PRIZES NOT TRANSFERRABLE: There is no cash value for prizes, no substitutes and prizes are not transferrable.

10        DELIVERY OF PRIZE: Prizes will be delivered on the day and during the time of the Contest to the first 50 eligible winners.  Failure to comply with these Terms and Conditions will result in disqualification.

11        IDENTIFICATION: In the event of a dispute over the identity of a potential winner, the potential winner may be required to provide identification sufficient to show that he or she is the subscriber of the winning Twitter account.  If identification provided is insufficient, the prize will be deemed non-deliverable.

12        NO EXCESS PRIZES: Under no circumstances will Collective Bias, LLC, Smart & Final, their affiliates, subsidiaries, and independent contractors, and their respective directors, officers, employees, and agents, including advertising and promotion agencies, be required to award more prizes than indicated in these Terms and Conditions or award prizes other than in accordance with these Terms and Conditions.

13        LIMITATION OF LIABILITY: By entering this Contest, each entrant acknowledges and agrees that Collective Bias and sponsor: (i) shall have no liability of any kind whatsoever with respect to this Contest and/or the awarding, use and/or misuse of any prize; (ii) make no warranty, guarantee or representation of any kind concerning any prize; (iii) disclaim any implied warranty; and (iv) are not liable for injury, loss or damage of any kind resulting from the entrant’s acceptance, use or misuse of, or participation in, a prize or otherwise from such entrant’s participation in this Contest.

14        THIRD PARTY SUPPLIERS: Collective Bias is not responsible for incomplete, lost or late entries or faulty transmissions, technical computer hardware or software failures of any kind, lost or interrupted or unavailable network connections, or failed, incomplete, garbled, misrouted, scrambled or delayed computer transmission, or other errors or problems of any kind, whether mechanical, human, electronic or otherwise, which may limit an entrant’s ability to participate in this Contest.  Collective Bias is not responsible for any problems related to the entrant’s use of Twitter for participation in this Contest, including, but not limited to, the suspension of entrant’s account on Twitter.

15        INDEMNIFICATION: By participating, the entrant agrees: to defend, indemnify and hold Collective Bias and the featured retailer/brand harmless against any and all claims, loss, liability, injury or damage to entrant or any other person or entity due in whole or in part, directly or indirectly, by reason of their acceptance, possession or use of a prize or their participation in this Contest, or breach of the disparagement terms of these Terms and Conditions. 

16        AMENDMENT OR TERMINATION: Collective Bias reserves the right to cancel, postpone, suspend and/or modify the Contest for any reason as determined at the sole discretion of Collective Bias. Collective Bias reserves the right, at its sole discretion, to disqualify any individual it finds to be: (a) falsifying an entry or providing false information; (b) tampering with the operation of the Contest; (c) in violation of these Terms and Conditions; or (d) acting in a fraudulent or deceptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be in violation of criminal and civil law, and Collective Bias reserves the right to seek damages from any such person to the fullest extent permitted by law.

17        NON-DISPARAGEMENT: The entrant shall, during and after the participation in the Contest, refrain from making any statements or comments of a defamatory or disparaging nature to any third party regarding any other entrant, Collective Bias or the sponsoring retailer/brand. 

18        ENTIRE AGREEMENT; These Terms and Conditions constitute the entire agreement between Collective Bias and each contestant and there are no other terms and conditions or rules relating to the Contest.

 19        GENERAL MATTERS: If any part or parts of these Terms and Conditions shall be held unenforceable for any reason, the remainder of these Terms and Conditions shall continue in full force and effect.  These Terms and Conditions and any disputes that may arise in connection with these Terms and Conditions shall be governed by the laws of the State of Michigan.  Collective Bias’ failure to enforce any provision of these Terms and Conditions shall not constitute a waiver of that provision. The decisions of Collective Bias in relation to this Contest will be final and binding on all entrants.
